To sue or not to sue?
WHAT IF the city impounded your pet and wouldn’t let you have visitation… what would you do?
“On Monday, I sent another request to Animal Services for permission to see Brindi. Two weeks ago, after sending three letters in a row, I got a written refusal. There is no law or written policy banning [visitation].” October 2008
“Before leaving the [courthouse], we asked the city’s counsel once again if I could be allowed to visit Brindi. Answer: a flat NO.” January 2009
WHAT IF your only alternative to save your pet from euthanasia was to sue the city… would you do it?
In 2008, Francesca Rogier pursued that very alternative. In January, 2009, the Supreme Court declared certain portions of By-law A-300 invalid and quashed the decision to have Brindi euthanized.
Nova Scotia Supreme Court Judge Duncan Beveridge quashed Brindi’s original euthanization order because the city failed, he wrote, to accord Rogier “even the most minimal requirements for procedural fairness.” One example? In what the city called its “complete investigation” of the third attack, no one bothered to take a statement from, or even contact, Rogier. [The Coast]
Brindi should have been a free dog that day.
Instead, the city launched their second attempt to KILL BRINDI. They charged Francesca Rogier with three violations of the By-Laws.
The city continues, today, to hold Brindi.
Please call and/or email the Mayor of Halifax and the head of the city’s Legal Department. Ask them to correct this iniquity and return Brindi to her owner, Francesca Rogier.
It should not be wrong to stand up for what is right.

I would not rest if i knew within my heart my dog should live and had been unfairly convicted. I would defintely sue the city as Francesca has. In fact, I believe she has showed considerable restraint, as not only would I attempt what she has done, but I doubt I would have the patience to see this through when taking into account the enormous stress and emotional hardship that has to be endured. Instead I would go to great lengths to break my dog out of her prison and we would disappear 'undergound' forever, if necessary.

can u post a sample letter we can use to send to the mayor? I dont even know what to state in the letter but I'd really like to send emails/letters and pass it on to friends to also send.

It is probably best if you write your own letter in your own words, so it doesn’t look as though we are all following a script….this is one of the many letters I wrote, but each time I write I write a different one. They are not always as long as this; sometimes I just write a few lines. Feel free to use any of my points below if you like.
“I and thousands of other people around the world have been following this case for many months, with great concern for Brindi, who is still in custody.
I am extrememly disappointed that this matter is still continuing. Brindi is not a dangerous dog, and she should not have been locked up for the past fifteen months. She should most certainly not be on Death Row either; this is a travesty of justice. Ms Rogier has clearly shown her commitment to resolving this issue, and her commitment to her dog greatly surpasses that of most dog owners. She has taken a number of responsible steps to prevent any future problems, such as building a fence to keep Brindi on the Rogier property and other dogs off the property. In addition, Brindi has been assessed by a dog behaviourist as being highly trainable…. See More
This is clearly not an extreme case involving a vicious dog, and “euthanization” is therefore completely inappropriate. This is a dog with a loving home who should not be languishing in a shelter, taking up a space that must surely be needed by a homeless dog.
It is very unfortunate that the City of Halifax has shown neither compassion nor common sense in their handling of this. This matter has taken up enough of the Court’s time already. Both Brindi and Ms Rogier have been made to suffer far more than they should have, and I ask you to now do the right thing and urge the City of Halifax to withdraw all charges against Ms Rogier and let Brindi return home as a matter of urgency”

I most definitely sue and would also consider pressing criminal charges if I could. I think the best policy in this instance is to fight fire with fire.

It's not fair to the family or to Brindi. How is the family sure that Brindi is still alive and ok? Are they taking care of Brindi? Do they have proof of how Brindi is doing? Why do they keep refusing? I say the family has every right to sue!!

Damn right I would sue them!!! No one knows how Brindi is doing, we do know that in the past she has had pancretitis and gum disease but only the Shelter vet is allowed to see or treat her. And there is no proof that any treatment has been done. Its a childish game that has gone way beyond its time and now a life is at stake. Its time to bring Brindi home!!!!!!!!!!!!!!!!!!
